Inevitably some projects experience difficulties with builders which at best cause friction and at worst may ultimately end in the parties going their separate ways. This is often avoidable and may be resolved through the diplomatic intervention of an experienced third party. Our experience in formal dispute resolution can help achieve a workable solution for the parties involved.
In the vast number of cases building projects are completed with minimal issues. However, when problems do arise, we believe that the earlier a solution is obtained the better able you are to mitigate the impact of the problem. It is advisable to adopt a pro-active approach to resolve any problem that may arise. This will help reduce any time and cost implications that may ensue.
It is also recognised that there is significant ‘stress’ imposed through the learning curve of the building process. Undue stress is not desirable, as it can have a longer term effect on how decisions are made and the emotional consequences when the project is complete.
With early intervention, RACS endeavours to help Clients find the solution before it becomes a problem.
Project related difficulties can also affect the Contractor. Often Contractors can also be in a position that they are losing money and are often unable to precisely identify the cause. This will likely become apparent during the later stages of a project, typically where works become more critical. Stereotyping, often Contractors fail to record much of the work being carried out on site and suffer the consequence of not being able to identify delay and or variation to the work. This may in turn become a difficult cycle to break and will likely create difficulties between the Client and Contractor.
Our aim is to provide professional construction related services to both the construction industry and the domestic market. With over 30 years commercial, management and dispute resolution experience we are well placed to do so.
Often where issues have arisen relationships between the Parties can become strained and even untenable. We are able to conciliate with the Parties in an effort to quickly resolve the problem. The benefit of this process is that it is hoped that the Parties can continue to work together.
